JobGuru is committed to protecting the confidentiality and privacy of information entrusted to us. This Privacy Policy is for this website, jobguru.ie, and served by JobGuru Ltd. It governs the privacy of its users who choose to use it and sets out what information we collect, how we collect it, what we do with it, and how we protect this information. Your personal data is processed in accordance with European data protection laws.

1. WHO WE ARE. 

The Website is owned and operated by JobGuru Ltd. (“JobGuru”), which provides an online employment marketplace (platform) that connects Employers and Jobseekers. The JobGuru entities are responsible for keeping your information safe and private. This section determines which JobGuru entity acts as the controller or processor of your Personal Data.

 JobGuru as Controller: For the purposes of this Privacy Policy, “JobGuru”, "jobguru", "Jobguru", "jobguru.ie" “we” or “us” means: JobGuru Ltd. JobGuru is the controller of all Personal Data processed pursuant to this Privacy Policy. Please also note that the contracting entity indicated in our terms of service may differ from the data controller indicated in this Privacy Policy.

 JobGuru as Processor: JobGuru offers certain hiring services to Employers where JobGuru acts as the data processor, or similarly, under applicable data protection laws, and processes the personal data it collects from and about you only on the Employer’s behalf, subject to our Terms.  If you have any questions about JobGuru’s processing of your personal data as part of these services, or to exercise any rights you may have with respect to such information, please contact contact us at the following email address: legal@jobguru.ie. The remainder of our processing activities covered by this Privacy Policy does not apply to Personal Data that we collect through these services.

2. WHAT DATA DO WE COLLECT? 

Your Personal information may be collected by us when you register on JobGuru digital platform. We may collect and store different kinds of your Personal Data. If you do not allow us to collect your Personal information, you may not be able to access and use some of the functionality on JobGuru's digital platform services or options and you accept that as a condition of service. If you do not want to provide your Sensitive information, you can choose not to include Sensitive information in your CV and Cover Letter when you upload them onto the JobGuru digital platform.

Personal Data:

“Identity Data” such as first name, maiden name, last name, curriculum vitae (CV/resume) information, cover letter or cover email, Social Media profile, username, or similar Personal Data may also be collected from a third party, including Employers whom you have contacted via the JobGuru digital platform.

“Contact Data” such as a physical address, email address, social media address, mobile or landline telephone number, and other contact information you may provide.

“Financial Data”. Please note that payment methods (e.g., credit card number and/or PayPal and/or bank account details) are not collected by us directly and are being processed by secure payment service providers (Revolut / PayPal).

“Transaction Data” such as details about payments, and details regarding the services that you have subscribed to in relation to this Site.

“Technical Data” such as Device IDs, your login data, access dates and times, browser type and version, device information, cookie data, time zone setting and location, browser plug-in types and versions, operating system and platform, and other technology on the devices you use to access the Site.

“Profile Data” such as your username and password, orders made by you, preferences, user-generated content, job searches, candidate searches, job applications, feedback, and survey responses. 

“Usage Data” such as information about how you use our Site, products, and services.

“Marketing and Communications Data” such as your preferences in receiving marketing from us and our third parties and your communication preferences.

Any other Personal Data JobGuru may receive from third parties. Any Personal Data that JobGuru may obtain from other third-party sources, including data from sponsored advertisements that we have on third-party sites, will be processed by JobGuru in accordance with this Privacy Policy and all applicable laws.

Non-Personal Data:

We also collect, use, and share Aggregated Data such as statistical or demographic data for any purpose. Aggregated Data may be derived from your Personal Data but is not considered Personal Data since it does not directly or indirectly reveal your identity. For example, we may aggregate your Usage Data to calculate the percentage of users accessing a specific website feature. We will also aggregate your Usage Data and certain Profile Data, such as job searches and job applications, to improve our Site, products, and services.

Please note that some Employers are required by law to ask each job applicant to provide their Demographic Information on a voluntary basis, and you may see these questions after applying to jobs on JobGuru.

By accessing JobGuru through your Facebook or Google account, you understand that Facebook or Google will share certain data for the purposes of authentication to permit you to access JobGuru in a secure manner. You may stop this at any point from your Facebook or Google account. This information will be considered JobGuru account information for purposes of your use of JobGuru.

You have the ability to disable the connection between your Facebook or Google account and your JobGuru account at any time by accessing your privacy settings on your Facebook or Google account. Facebook or Google may also ask for your permission to share certain other details with JobGuru, including but not limited to your name, profile picture, public profile information, and email address. Once you give this permission, the requested information will be shared with JobGuru. This information will be used to provide services to you, including populating your JobGuru profile. The shared information will remain associated with your JobGuru Profile until you modify or delete it.

PLEASE NOTE THAT YOUR RELATIONSHIP WITH FACEBOOK OR GOOGLE OR ANY OTHER THIRD-PARTY WEBSITE IS GOVERNED SOLELY BY YOUR AGREEMENT WITH SUCH A THIRD-PARTY WEBSITE.

If you are an Employer, we may request that you provide certain information in order to verify your account. This information may include, but may not be limited to, your Companies Registrations Office Number (CRO), VAT Number, Business Registration information, copy of the Company utility bill, and the name and email address of an Employer Representative. This information will be used for internal purposes only, subject to any request by law enforcement or court order.

JobGuru’s core mission is to help Jobseekers get jobs and help Employers to find great candidates. 

3. HOW DO WE COLLECT THE DATA?

 We use different methods to collect Personal Data from and about you including, for example: 

Direct Interaction: You may give us your identity, contact, billing, and other information by filling in forms on our website or by corresponding to us by post, phone, e-mail, or otherwise. 

Automated Technologies or Interactions: As you interact with our Site, we may automatically collect Technical Data and Usage Data about your equipment, browsing actions, and patterns. We collect this Personal Data and Non-Personal Data by using cookies, server logs, and other similar technologies. We may also receive Technical Data and Usage Data about you if you visit other websites employing our cookies and other Tracking Technologies (defined below). Third Parties: We may receive Personal Data in the form of Technical Data and Usage Data from various third parties such as analytics providers or advertising networks.

4. HOW DO WE USE YOUR DATA?

JobGuru complies with its obligations under the Data Protection Acts by keeping personal data up to date; by storing and destroying it securely; by not collecting or retaining excessive amounts of data; by protecting personal data from loss, misuse, unauthorised access and disclosure, and by ensuring that appropriate technical measures are in place to protect personal data. 

Use of Personal Data: We will only use your Personal Data where permitted by European data protection laws. Most commonly, we will use your Personal Data in the following circumstances: To provide the services you requested. To respond to your query. To send you email marketing communications about events and information that we think may be of interest to you (only if you consent to it).

 We will share your personal data if we are required to do so by law - for example, by court order, or to prevent fraud or other crimes.

Use of Non-Personal Data: Non-Personal data is electronic data that does not contain any information that can be used to identify a natural person. Where permitted by European data protection laws, we may use the Non-Personal data for any purpose not prohibited by law. The Non-Personal data we collect may be shared with government departments, agencies, and public bodies. It may also be shared with our technology suppliers, for example, our hosting provider.

5. HOW LONG DO WE KEEP YOUR PERSONAL DATA?

We keep your personal data for no longer than reasonably necessary for a period of three years in case of any claims/complaints.

6. CHILDREN'S PRIVACY PROTECTION

Our services are not designed for, or intentionally targeted at, children 16 years of age or younger. We do not intentionally collect or maintain data about anyone under the age of 16.

7. WHERE YOUR DATA IS BENG PROCESSED AND STORED?

We design, build and run our systems to make sure that your data is as safe as possible at all stages, both while it’s processed and when it’s stored. Information we collect will not be processed in or transferred to any country or territory outside of the European Economic Area. If we undertake international transfers in the future, you will be contacted before any such transfer takes place with the following information:

- Details regarding the transfer to the third country;

- What safeguards are in place;

8. HOW DO WE PROTECT YOUR DATA AND KEEP IT SECURE?

The security of your personal data is important to us. We restrict access to personal information to JobGuru employees, contractors and processors who have a requirement to process your personal information.

9. WHY DO WE COLLECT THIS INFORMATION? 

We collect and use your information in order to help Jobseekers to find jobs and to help Employers to find candidates, and to provide and improve our services to you. To summarize, we use your Personal Data, where applicable, to: 

- Create your account and send you job alerts or other promotional materials (only if you consent to it); 

- Provide you with relevant search results and job recommendations; 

- Facilitate communication as part of the job search, application and interview process;

- Make your CV available to Employers (only if you consent to it); 

- Match Jobseekers with Employer's Job Listings; 

- Facilitate payment, in connection with chargeable services; 

- Carry out automated processing in order to provide many of our services; 

- Improve our services, maintain product quality and protect users; 

- Prevent fraud, spam, and other potentially fraudulent or illegal activities; 

10. YOUR RIGHTS

Right to Access: The right to be provided with a copy of your Personal Data (subject to certain restrictions).

Right to Information: The right to know what Personal Data we hold about you and how we use it.

Right of Rectification: The right to require us to correct any incomplete or inaccurate Personal Data we hold about you, though we may need to verify the accuracy of the new data you provide to us. If you have a user account with us, you also have the option of correcting your information directly in your account.

Right to restrict processing: The right to require us to restrict the processing of your Personal Data, i.e., you can request that we suspend the processing of your Personal Data in the following scenarios: if you want us to establish the data’s accuracy; where our use of the data is unlawful but you do not want us to erase it;  where you need us to hold the data even if we no longer require it as you need it to establish, exercise or defend legal claims; or you have objected to our use of your data but we need to verify whether we have overriding legitimate grounds to use it.

Right to erasure/be forgotten: This enables you to ask us to delete or remove Personal Data where there is no good reason for us to continue to process it. Note, however, that we may not always be able to comply with your request for erasure and in such circumstances, will notify our reasons to you.

Right to object to processing: You have the right to object to the processing of your Personal Data in the following circumstances: at any time to your Personal Data being processed for direct marketing (including profiling); or  in certain other situations, to our continued processing of your Personal Data, e.g., our processing of your Personal Data when such processing is based on our legitimate interests. In some cases, we may demonstrate that we have compelling legitimate grounds to process your information which override your rights and freedoms.

Right to request data portability: In certain circumstances, you have the right to request the transfer of your Personal Data to you or to a third party in a commonly used machine-readable format. Note, however, that this right only applies to automated information which you initially provided consent for us to use or where we used the information to perform a contract with you.

Right to withdraw consent at any time: You have the right to withdraw your consent at any time when we are relying on consent to process your Personal Data. However, this will not affect the lawfulness of any processing carried out before you withdraw your consent. If you withdraw your consent, we may not be able to provide certain products or services to you. We will advise you if this is the case at the time you withdraw your consent.

Right not to be subject to a decision based solely on automated decision-making: The right not to be subject to a decision based solely on automated processing (including profiling) that produces legal effects concerning you or similarly significantly affects you. However, your right does not apply if:  you gave us your explicit consent to use your Personal Data to make our decision;  we are allowed by law to make our decision, or our automated decision was necessary to enable us to enter into a contract with you.


Requesting Your Information:

Upon request, Jobguru will provide you with information about whether we hold any of your personal information. If you would like to exercise any of the data subject access rights in the table above (each, an “Access Request”), you can contact us at the following email address: legal@jobguru.ie and identify the specific website to which your request relates.

No fee is usually required. You will not usually be required to pay a fee to access your Personal Data (or to exercise any of the other rights). However, we may charge a reasonable fee if your request is clearly unfounded, repetitive, or excessive. Alternatively, we may refuse to comply with your request in these circumstances and, in such case, we will notify you within a reasonable timeframe regarding our reasons for refusing to act on your request.

What we may need from you. Once we receive your Access Request, we may need to request specific information from you to help us confirm your identity and ensure your right to access your Personal Data (or to exercise any of your other rights). This is a security measure to ensure that Personal Data is not disclosed to any person who has no right to receive it. If we are not clear as to what you are requesting, we may also need to contact you for clarification so we can respond more fully to your request. If we cannot locate any records about you, we may also ask you for additional information to assist us in locating records, if they exist.

Time limit to respond. We try to respond to all legitimate requests within one month. Occasionally it may take us longer than a month if your request is particularly complex or you have made a number of requests. In this case, we will notify you and keep you updated.

11. CHANGES TO THIS POLICY. 

We may change this Privacy Policy. In that case, the ‘last updated' date at the top of this page will also change. Any changes to this privacy policy will apply to you and your data immediately. By using the JobGuru Site or providing information to us following such changes, we assume that you have accepted the amended Privacy Policy.
